Another firm victory, as trial court permits consideration of crucial testimony

Trial court permits jury to consider Judith Barnett’s claim that had she not been unlawfully fired because of her age and sex, she would have been promoted to Partner in large, international consulting firm. The trial court rejected PA’s motion to exclude this evidence because “Evidence in the record demonstrates that Plaintiff's direct supervisor, James Miller, thought Plaintiff ‘was doing great work, making lots of money for [PA], and on track for promotion.’” The trial court also rejected PA’s motion to exclude Plaintiff’s expert testimony and limit her back pay award.
